All online purchases made on the website www.hercule-studio.com
are subject to prior acknowledgment and acceptance of these General Terms and Conditions of Sale.
- Article: Products of any kind offered for sale (e-commerce service) on the Site.
- Client: A natural person, not acting as a trader, placing an order and possessing full legal capacity.
- Order: The commitment to purchase all items selected by the client via the Site’s e-commerce service.
- Site: Website operated by Hercule Studio, accessible at www.hercule-studio.com
- Introduction
These General Terms and Conditions of Sale (hereinafter “GTC”) apply exclusively between any client and HERCULE STUDIO, with registered office at 40 Rue Gioffredo, 06000 Nice, registered with the Nice Trade and Companies Register under number 900 632 605. Visitors can access the GTC from any page of the Site. The GTC apply without restriction or reservation to all items offered for sale on the site. Any order on the site is conditional upon the client’s prior and unconditional review and acceptance of these GTC and applicable prices. Placing an order through the Site’s procedure constitutes acceptance of these GTC. These GTC prevail over any other document.
2. Warning
Sales on the Site are exclusively reserved for retail and private individuals. Under no circumstances may the Site be used by professional selling clients, either individually or collectively, regardless of the sales method (online marketplaces, shopping galleries, intermediaries, physical stores, etc.). The client acknowledges and accepts that items may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of items per order and the number of individual orders of the same product. Hercule Studio reserves the right to refuse any order clearly placed by a professional selling client.
Clients acknowledge the unreliability of the internet, particularly in terms of data transmission security, continuity of access, performance, and the risk of viruses. Hercule Studio advises clients to implement security measures on their devices to prevent virus propagation.
The GTC may be modified; the applicable version is the one in effect on the Site at the date of the order.
3. Customer Account Creation
Any adult client may freely and voluntarily create a personal account via the “Create an Account” section. The client provides identification information, which must be accurate, complete, and updated. The client chooses a username (email) and password, which are personal and confidential. In case of suspected unauthorized use, the client must immediately alert Hercule Studio. Hercule Studio reserves the right to close accounts or refuse sales in cases of:
Non-payment of previous orders
Misuse, fraud, or violation of the GTC
Notification will be sent by email in such cases.
4. Item Characteristics
Items available for sale are those listed on the Site. Offers are valid while visible and within available stock. Hercule Studio reserves the right to remove, replace, or modify any item at any time. In case of unavailability after an order, the client will be informed by email, and the order will be automatically canceled. Items can be shipped to EU countries, Iceland, Norway, Switzerland, and the UK. Product descriptions (photos, graphics, descriptions) are indicative and non-contractual. Errors or omissions limit Hercule Studio’s liability to reasonable return shipping costs.
5. Ordering Items
Orders require client identification (name, address, phone, email). The client declares being at least 18 years old or, if a minor, authorized by a parent. Orders are submitted by following the online process and clicking “Order.” Payment confirmation constitutes acceptance of the GTC. Confirmation emails are sent after order validation. Hercule Studio cannot be held responsible for input errors preventing confirmation emails or delivery.
6. Item Prices
Prices are in euros, including VAT and applicable discounts. Additional taxes or fees may be applied. Prices exclude shipping and potential customs fees. Shipping fees are displayed before order confirmation. Hercule Studio reserves the right to modify prices at any time; items are billed based on prices at the time of order validation. Items remain the property of Hercule Studio until full payment.
7. Payment
Orders are payable immediately by credit card (CB, Visa, MasterCard, AmEx), Amazon Pay, or PayPal. Transactions are processed securely via a payment platform encrypting payment data.
8. Delivery Conditions
Items are shipped to EU countries, Iceland, Norway, Switzerland, and the UK. Orders before noon (French time) are shipped the same day. Shipping fees by zone are:
Zone 1: France mainland – standard delivery free from €150 purchase, home 8€, express 13€, pickup free
Zone 2: Germany, Belgium, Luxembourg, Netherlands – standard from €150, home 10€, express 18€
Zone 3: Austria, Spain, Portugal, Italy, Denmark, Hungary, Poland, Czechia, Slovakia, Ireland – standard from €170, home 11€, express 23€
Zone 4: Estonia, Latvia, Lithuania, Slovenia, Sweden, Switzerland, Bulgaria, Cyprus, Croatia, Finland, Greece, Iceland, Malta, Norway, Romania, UK, DOM-TOM – standard from €275, home 18€, express 30€
Zone 5: Japan, South Korea, Taiwan – standard from €350, home 30€, express 45€

Clients can track shipments via the carrier’s website. Hercule Studio is not responsible for delivery delays due to client unavailability. Shipping costs are non-refundable.
9. Returns
Clients have 14 days from receipt to return items for a refund. Return costs are client’s responsibility by zone:
- Zone 1: €10
- Zone 2: €12
- Zone 3: €15
- Zone 4: €25
- Zone 5: €40
Refunds are only provided if the delivered item is incorrect or damaged (photos required). Items must be unused, undamaged, clean, and in original packaging with labels. Returns unsuitable for resale will be rejected. Refunds are issued within 72 hours (maximum 10 days) via the original payment method, minus return shipping fees. Sale/Promotion/Outlet items are non-refundable; a store credit will be offered.
10. Return Procedure
Clients must contact Hercule Studio via the contact form with order date and number. Hercule Studio provides a return label to print and attach to the original box.
11. Right of Withdrawal
Under national and EU law, clients have 14 days from receipt to exercise the right of withdrawal without reason or penalty, except for return costs. Items must be returned in original packaging and resalable condition. Refunds are made within 30 days via the original payment method. Return costs are borne by the client.
12. Customer Service
For information, order tracking, or exercising withdrawal rights, clients must contact customer service via the contact form.
13. Warranties
Items are guaranteed against defects under Articles 1641–1649 of the French Civil Code and L 211-1 et seq. of the Consumer Code. Clients may return defective or non-conforming items for a refund.
14. Proof Agreement
Order records on Hercule Studio servers are considered valid proof of transactions and GTC acceptance. Clients may print, download, or save a copy of the GTC at any time.
15. Liability
Hercule Studio may modify site information at any time. Photos or descriptions may vary slightly; price differences do not entitle clients to refunds. Hercule Studio is not liable for delays due to force majeure, including strikes, civil unrest, natural disasters, or transport disruptions.
16. License
Hercule Studio grants personal, non-commercial use of the site. No part of the site may be copied, modified, sold, or used commercially without written permission. Hyperlinks require prior approval.
17. Personal Data and Cookies
The site complies with French law n°78-17 (CNIL declaration n°2039445). Account information is used solely for commercial relationship purposes. Bank data is not stored; transactions are processed securely. Cookies are used after user consent. Users may block cookies via browser settings.
18. Commercial Offers and Newsletters
Hercule Studio may send offers via email, SMS, phone, or website, subject to prior consent. Clients can unsubscribe at any time via the link in emails.

20. Amendments to GTC
Hercule Studio may modify the GTC at any time. New GTC apply only to sales made after the modification.
21. Governing Law
These GTC are governed by French law. Disputes fall under the exclusive jurisdiction of French courts at the client’s domicile, unless amicable agreement is reached.
